Talkfolio is a platform that allows candidates to create structured professional profiles and allows recruiters or hiring stakeholders to review those profiles, interact with AI-supported question flows, and assess candidate information in a more structured way.
By using Talkfolio, you agree to these Terms. If you do not agree, you should not use the service.
2. Who These Terms Apply To
These Terms apply to all users of Talkfolio, including:
- candidates
- recruiters, hiring managers, employers, and evaluators
- visitors to the website or public profile pages
- account holders
- any person interacting with Talkfolio features
3. The Service
Talkfolio provides tools for:
- creating and managing candidate profiles
- publishing structured professional information
- enabling recruiter interaction with those profiles
- generating AI-supported responses based on candidate-provided materials
- tracking profile interaction and related product signals
- supporting candidate presentation and recruiter evaluation workflows
Talkfolio may change, improve, suspend, or remove parts of the service over time. We do not guarantee that every feature will always remain available in the same form.
4. Eligibility and Accounts
To use certain Talkfolio features, you may need to create an account. You agree that:
- the information you provide is accurate to the best of your knowledge
- you will keep your account credentials secure
- you are responsible for activity under your account unless caused by our failure
- you will not impersonate another person or organization
- you will not create accounts through unauthorized automated means unless explicitly allowed
If you create an account on behalf of a company or another entity, you confirm that you have authority to do so.
5. Candidate Content
Candidates may upload, write, structure, publish, and manage content such as CV or resume data, work history, evidence, profile narratives, achievements, recommendations, curated answers, supporting files, and optional transcripts or voice-derived material.
The candidate remains responsible for the accuracy and lawfulness of the material they submit. Talkfolio may provide structure, formatting, AI-assisted outputs, and presentation layers, but the candidate remains responsible for the underlying truthfulness of profile claims.
6. Integrity of Content
Talkfolio is built around professional credibility. By using the platform as a candidate, you agree that you will not knowingly:
- submit false information
- exaggerate ownership of work you did not own
- hide the difference between observed, influenced, designed, delivered, proposed, and owned work
- impersonate another person
- misrepresent your employment history, responsibilities, or outcomes
- upload evidence you have no right to use
Violation of these standards may lead to restriction, removal, or suspension.
7. Recruiter Use
Recruiters and hiring stakeholders may use Talkfolio to review candidate profiles and interact with profile content. Recruiters agree that they will not:
- misuse candidate data
- scrape or mass-harvest profile data without authorization
- resell or republish candidate profile content without permission
- attempt to access hidden, restricted, or non-public data
- use the platform in a way that violates privacy, discrimination, employment, or data-protection law
- upload malicious input, prompts, code, or files intended to disrupt the service
Private recruiter notes and internal evaluation tools are intended for authorized internal use only.
8. Acceptable Use
You agree not to use Talkfolio to:
- violate any applicable law or regulation
- infringe intellectual property, privacy, or confidentiality rights
- distribute malware, harmful code, or malicious payloads
- probe, scan, or test vulnerabilities without authorization
- interfere with the service or its infrastructure
- bypass access controls
- impersonate, defraud, harass, abuse, or deceive other users
- use bots or automation in a way that harms the platform or exceeds permitted usage
- copy, mirror, or extract substantial parts of the service without permission
We may investigate suspected misuse and take appropriate action.
9. AI Features and Generated Responses
Talkfolio may use AI to generate answers, summaries, or structured outputs based on candidate-provided data and recruiter questions. By using these features, you understand and accept that:
- AI outputs are generated from available profile material and system logic
- AI outputs may simplify, summarize, or organize information
- AI outputs are not a substitute for independent human judgment
- Talkfolio does not guarantee that every generated answer is complete, error-free, or suitable for every hiring decision
- users remain responsible for how they interpret and use AI-generated outputs
Candidates are responsible for the underlying profile content. Recruiters are responsible for their own hiring decisions.
10. Privacy
Use of Talkfolio is also governed by the Privacy Notice, which explains what personal data is processed, why, how it is protected, and what rights users may have. If there is a conflict between these Terms and the Privacy Notice on a privacy-specific issue, the Privacy Notice governs.
11. Intellectual Property
Talkfolio and its underlying service, interface, branding, design system, software, workflows, and platform materials are owned by Talkfolio or its licensors, except for user content and third-party materials.
Subject to these Terms, Talkfolio grants users a limited, non-exclusive, revocable right to access and use the service for its intended purpose. Users may not copy or reproduce the platform except as allowed by law, reverse engineer the service except where non-waivable law permits, remove branding or legal markings, or create derivative commercial services from Talkfolio without authorization.
12. User Content Rights
Users retain their rights in the content they submit. By uploading or submitting content, you grant Talkfolio a limited right to host, store, process, display, reformat, and transmit that content as necessary to provide the service, operate profile pages, generate AI-supported outputs, maintain the platform, enforce these Terms, and comply with legal obligations.
This right is limited to operation of the service and does not mean Talkfolio takes ownership of your content.
13. Profile Publication and Visibility
Candidates are responsible for the visibility state they choose. Talkfolio aims to provide clear controls for publication and visibility, but candidates should review their settings carefully before publishing.
Talkfolio is not responsible for third parties viewing, saving, or acting on information that the candidate intentionally made visible through the service.
14. Suspension and Termination
Talkfolio may suspend, restrict, or terminate access where reasonably necessary, including if these Terms are violated, the service is misused, fraudulent or harmful behavior is suspected, or continued access creates risk to other users or the platform.
Where appropriate, we may warn users first. In serious cases, we may act immediately. Users may stop using the service at any time, subject to account closure, billing, and data-retention conditions.
15. Availability and Changes
Talkfolio aims to provide a reliable service but does not guarantee uninterrupted availability. The service may be affected by maintenance, security events, provider outages, technical limitations, or product evolution. We may modify, replace, or discontinue features where reasonably necessary.
16. Disclaimers
Talkfolio is provided on an “as available” and “as is” basis except where applicable law requires otherwise. To the extent permitted by law:
- we do not guarantee uninterrupted or error-free service
- we do not guarantee that every AI output will be fully accurate or suitable for a specific purpose
- we do not guarantee that use of the service will result in hiring outcomes, interviews, offers, or business results
Nothing in these Terms excludes rights that cannot legally be excluded.
17. Limitation of Liability
To the extent permitted by law, Talkfolio will not be liable for indirect, incidental, special, consequential, or purely economic losses arising from use of the service.
To the extent permitted by law, Talkfolio's liability for claims arising out of or relating to the service will be limited to the amount paid by the relevant user in the 12 months before the event giving rise to the claim, or a reasonable minimum statutory amount where no such payment exists.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for fraud, wilful misconduct, or personal injury where applicable law says so.
18. Third-Party Services
Talkfolio may rely on third-party providers for hosting, authentication, payments, analytics, AI processing, storage, or communications. We are not responsible for third-party services beyond the responsibility imposed by applicable law. Use of some parts of the service may also involve third-party terms.
19. Changes to These Terms
We may update these Terms from time to time. If changes are material, we may update the effective date, publish the revised version, show an in-product notice, or request renewed acknowledgment where appropriate. Continued use of Talkfolio after updated Terms take effect may constitute acceptance, unless applicable law requires a different mechanism.
